Federal Court of Appeal decision a mixed outcome for Canadian creators and publishers

On April 22, the Federal Court of Appeal released its decision in the appeal of the Federal Court of Canada decision in the legal action between Access Copyright and York University.

While Access Copyright is pleased that the Court upheld the trial court’s decision and the rights of creators and publishers with its judgment on fair dealing, we are disappointed that the Court found that tariffs are not mandatory which exacerbates the challenges faced by content creators to receive fair compensation.
